1. Acceptance & Scope of Agreement

By accessing, registering for, or using the platform at iqclearance.com("the Platform"), athletic directors, medical personnel, athletic trainers, coaches, and school representatives ("Users" or "Institutions") agree to be legally bound by these Terms of Service.

If you are entering into this agreement on behalf of an educational institution, athletic association, or club team, you represent that you have the legal authority to bind that entity to these terms.

2. Clinical Boundaries & AI Decision-Support

The Platform provides administrative document routing, SCAT6 tracking, and legal compliance workflows (including Ontario's Rowan's Law protocols). Users explicitly acknowledge and agree that:

• No Doctor-Patient Relationship: Using IQClearance does not establish a clinical relationship between IQClearance Inc. and any student-athlete.
• Non-Clinical Decision Support: Automated status tracking, flags, or timeline calculations are administrative indicators. All medical decisions remain the sole responsibility of certified clinical professionals.
• Statutory Protocols: Institutions remain responsible for ensuring that physical documentation meets local, state, or provincial legislative frameworks.

We handle health and educational records in compliance with high-level security benchmarks across jurisdictions:

• Protected Health Information (PHI): Stored using AES-256 encryption at rest and TLS 1.3 protocol in transit.
• FERPA & PIPEDA Compliance: Student records are governed under strict educational privacy controls and Canadian PIPEDA/PHIPA frameworks.
• Business Associate Agreements (BAA): Institutional customers executing a formal BAA are provided custom enterprise compliance guarantees.

To the maximum extent permitted by applicable law, IQClearance Inc., its officers, developers, and partners shall not be liable for any direct, indirect, incidental, punitive, or consequential damages arising from:

• Athletic injuries, re-injuries, or physical health outcomes.
• Falsified, inaccurate, or incomplete documentation submitted by users or third parties.
• Failure of athletic staff or medical personnel to perform proper clinical evaluations prior to issuing clearance.

7. Governing Law & Legal Contact

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
